Application for a taxi operator licence

In order to operate a taxi service, the entrepreneur must have:

  • a business permit or decision in principle for taxi operators;
  • a taxi operator licence.

Compliance with the operating conditions for taxi operator is verified by the Taxi Office of the Ministry of Mobility and Public Works at the time the application for a taxi operator licence is submitted.

The taxi activity in Luxembourg is regulated and limited. Only a limited number of taxi licences granting the right to operate a taxi service are issued and the application procedure for a taxi operator licence differs according to the type of licence applied for ("standard" taxi operator licence or zero emissions taxi operator licence).

Taxi service operators who are legally established on the territory of the Swiss Confederation or in a country of the European Economic Area (EEA) and who are authorised to operate a taxi service may provide temporary and occasional international traffic services in Luxembourg without business permit, taxi licence and without giving prior notification.

However, if this activity is carried out on a regular basis, it has to be registered with the Ministry of the Economy.

Who is concerned?

The taxi licence is required for all natural persons or commercial companies who plan to operate a "taxi service", i.e. the occasional transport against payment of persons by taxi.

A taxi is a passenger motor vehicle with 4 to 9 seats for the occasional transport against payment of persons by road.

Operating a car rental business with or without driver is subject to a business permit but does not require a taxi licence.

The motor vehicle used for this activity cannot be equipped with taxi-specific equipment/signs (taximeter, illuminated sign, taxi sign, taxi-zone card - "plaque-zone-taxi).

Prerequisites

In order to provide proof of the qualifications required to operate a taxi service, the natural person or business manager must hold a valid business permit for taxi operators issued by the the General Directorate for Small and Medium-Sized Enterprises (Direction générale des Classes moyennes) at the Ministry of the Economy or a decision in principle for taxi operators.

How to proceed

Taxi operator licence ("standard" licence) and registration on the waiting list

Before submitting an application for a standard taxi operator licence, the applicant is required to register on a waiting list via My Guichet.

After the publication of a notice of vacancy in the Mémorial B, the applicant can submit the application for a taxi operator licence to the Taxi Office, either via MyGuichet, or by sending in the application form via registered letter with acknowledgement of receipt, together with the documents listed in the notice, namely:

  • a copy of the business permit or decision in principle issued by the Ministry of the Economy;
  • a copy of the registration certificate (part I) or, where applicable, the car manufacturer's certificate with the chassis number of the motor vehicle to be registered as a taxi;
  • proof of payment of the processing fee to the Registration Duties, Estates and VAT Authority (Administration de l'enregistrement, des domaines et de la TVA - AED);
  • a certificate from the Registration Duties, Estates and VAT Authority indicating the VAT number;
  • for commercial companies:
    • a copy of the passport, identity document, travel document or any other valid document which allows to identify the person who will be responsible for the effective and permanent management of the business;
    • a copy of the company’s articles of association;
    • an extract from the Trade and Companies Register (Registre de Commerce et des Sociétés - RCS) indicating the business registration number;
  • for natural persons:
    • a copy of the passport, identity document, travel document or any other valid document which allows to identify the applicant.

The allocation of "standard" taxi operator licences is undertaken according to the applicant's rank on the waiting list and in accordance with the number of vacancies published.

Transitional regime

Taxi licences issued under the amended law of 18 March 1997 may be exchanged for a taxi operator licence issued under the new law by sending a request for exchange of an operating licence (French, Pdf, 226 Kb) (demande d'échange d'une licence d'exploitation), by 1 March 2017, by registered letter with acknowledgement of receipt to the Ministry of Mobility and Public Works together with the following documents:

  • the authorisation for taxi operators issued by the commune or the state (for the airport);
  • a certificate from the commune of establishment certifying the validity of the authorisation for taxi operators;
  • the documents mentioned before required for a "standard" taxi operator licence.

Zero emissions taxi operator licence

All zero emissions licences for the year 2021 have be allocated.

Applicants for a zero emissions taxi operator licence have to:

  • purchase and use a zero-emissions taxi, i.e. a motor vehicle emitting "0" NOx and "0"CO2 and;
    • either be the owner or holder of a zero-emissions taxi;
    • or have a purchase contract or a leasing contract indicating the delivery date of a zero-emissions taxi.

They do not need to register on the waiting list before submitting the application for said licence.

A yearly quota of 20 zero-emission taxi operator licences, with a maximum of 3 licences per company or natural person, will be made available at the beginning of each calendar year.

The application for a zero-emissions taxi operator licence must be submitted via MyGuichet together with the following documents:

  • a copy of the business permit or decision in principle issued by the Ministry of the Economy;
  • a copy of the purchase or leasing contract indicating the delivery date of the zero-emissions taxi;
  • a copy of the registration certificate (part I) or, where applicable, the car manufacturer's certificate with the chassis number of the motor vehicle to be registered as a taxi;
  • proof of payment of the processing fee to the Registration Duties, Estates and VAT Authority (Administration de l'enregistrement, des domaines et de la TVA - AED);
  • a certificate from the Registration Duties, Estates and VAT Authority indicating the VAT number;
  • for commercial companies:
    • a copy of the passport, identity document, travel document or any other valid document which allows to identify the person who will be responsible for the effective and permanent management of the business;
    • a copy of the company’s articles of association;
    • an extract from the Trade and Companies Register (Registre de Commerce et des Sociétés - RCS) indicating the business registration number;
  • for natural persons:
    • a copy of the passport, identity document, travel document or any other valid document which allows to identify the applicant.

The granting of "zero-emissions" taxi operator licences is carried out in the order in which applications are received via MyGuichet within the limits of the available quotas per year.

Taxi operator obligations

Taxi operators must ensure that their drivers comply with the requirements of professional qualification and integrity, and that they respect the legislation on taxis.

Licence validity

The taxi operator licence is valid for 5 years, strictly personal, and linked to a particular vehicle.

The taxi operator must start his activity within 2 months of receipt of the taxi operator licence.

Renewal of the licence

The taxi operator licence can be renewed. Operators will receive a notification of renewal 3 months prior to the expiry of the licence validity.

Applicants have to submit the following documents to their application for renewal:

  • a copy of the business permit or decision in principle issued by the Ministry of the Economy;
  • a copy of the registration certificate (part I) or, where applicable, the car manufacturer's certificate with the chassis number of the motor vehicle to be registered as a taxi;
  • proof of payment of the processing fee to the Registration Duties, Estates and VAT Authority (Administration de l'enregistrement, des domaines et de la TVA - AED);
  • a certificate from the Registration Duties, Estates and VAT Authority indicating the VAT number;
  • for commercial companies:
    • a copy of the passport, identity document, travel document or any other valid document which allows to identify the person who will be responsible for the effective and permanent management of the business;
    • a copy of the company’s articles of association;
    • an extract from the Trade and Companies Register (Registre de Commerce et des Sociétés - RCS) indicating the business registration number;
  • for natural persons
    • a copy of the passport, identity document, travel document or any other valid document which allows to identify the applicant.

Modification/Duplicate of the licence

If the data which impact the conditions for obtaining the taxi driver licence change (e.g. company name, change of business manager or change of address), an application for modification must be submitted to the Service des taxis.

In the case of loss or theft of the licence, a duplicate can be issued.

Transcription of the licence

The taxi operator licence can be transferred to another car than the one for which the licence was registered.

In order to do so, applicants have to submit the following documents to their application for transfer:

  • the original taxi operator licence, or a copy thereof;
  • proof of deregistration of the old vehicle as a taxi;
  • and a copy of the registration certificate of the new vehicle (part I).

A zero-emissions taxi operator licence cannot be transferred to another vehicle which is not a taxi with “0” emissions of CO2 and NOx.

Temporary extension of the licence

A temporary extension of the taxi operator licence to a replacement taxi of the same type can be applied for via MyGuichet (e.g. in the case of an accident involving the taxi).

The temporary extension will automatically be notified to the taxi operator by electronic means. The extension is valid for 72 hours.

A temporary extension for more than 72 hours can be applied for in writing to the Ministry by stating the motive justifying the additional extension.

Temporary extensions are only valid together with the corresponding taxi operator licence.
