Declaring tattoo studios and establishments providing public tanning appliances

Anyone providing services involving tanning and tattooing techniques must declare the opening, closure or modification of their studio/establishment to the Health Directorate (Direction de la Santé).

These declarations concern:

  • tattoo studios;
  • establishments providing public tanning appliances.

Declarations must be made online via MyGuichet.lu.

To obtain the authorisation requested, the declarant and their staff must have undergone, depending on the case, specific training on hygiene and health conditions, or training on hygiene conditions and protection against ultraviolet radiations.

Who is concerned?

Every owner of a tattoo studio or establishment providing tanning appliances to the public.

That means that the following activities are concerned:

The following people are not concerned:

  • health professionals are not concerned if they only carry out healthcare acts;
  • anyone who has a business permit (autorisation d’établissement) as a jeweller issued by the General Directorate for Small and Medium-sized Enterprises (Direction générale des Classes moyennes), when piercing earlobes using an ear-piercing gun.

Prerequisites

Preliminary steps

Anyone offering tattooing services must have attended a training course lasting at least 21 hours on conditions for hygiene and health. This training must have been carried out at:

  • an authorised training establishment in Luxembourg; or
  • an establishment recognised by the competent authorities of the State providing the training courses attended in a European Union Member State.

Anyone making UV tanning appliances available for use by the public must have attended a training course lasting at least 8 hours on conditions for hygiene and protection against ultraviolet radiations. This training must have been carried out at:

  • an authorised training establishment in Luxembourg; or
  • an establishment recognised by the competent authorities of the State providing the training courses attended in a European Union Member State.

Deadlines

Owners of a studio/establishment must declare their activity one month before starting the activity.

Modifying or ceasing the activity must be declared within one month of the change in situation occurring or cessation of activity.

Costs

There is no charge for making the declaration.

How to proceed

Filing an application

The online procedure

Declarants submit their declaration online via MyGuichet.lu. They must log into their business eSpace on MyGuichet.lu to declare the opening, modification or cessation of activity of their studio/establishment.

They must indicate:

  • the full address of the establishment;
  • the date of the declaration;
  • their phone number and email address;
  • their 13-digit Luxembourg national identification number (matricule).

The declarant then selects the type of procedure: notification of commencing an activity, modification, or cessation of the activity.

Declaring a tattoo studio

The declarant must provide information about:

  • the tattoo studio:
    • the date of commencing the activity;
    • the name of the studio;
    • the name and first name of the manager;
    • the address of the studio;
  • the person making the declaration:
    • their name and first name;
    • their email address and phone number;
  • the activities carried out at the studio: tattooing/permanent make-up, body piercing, cutting, branding;
  • the names of the persons covered by the notification: their names and first names.

At the end of the procedure, the applicant must electronically sign the document listing all the information entered.

Declaring tanning appliances made available to the public

The declarant must provide information about:

  • the person making the declaration:
    • their name and first name;
    • their email address and phone number;
    • the name of the establishment's registered office;
    • the address of the registered office in Luxembourg;
  • the place(s) of operation:
    • the name(s) of the establishment(s);
    • the address(es) of the place(s) of operation;
  • UV appliances:
    • manufacturers;
    • models;
    • serial numbers;
    • UV ratings;
    • total actual radiation;
    • approved inspection bodies;
    • dates of last inspections;
  • the staff:
    • their names and first names;
    • their training, with date(s).

At the end of the procedure, the declarant must electronically sign the document listing all the information entered.

Particular points regarding modifying or ceasing the activity of a studio/establishment

Anyone wishing to modify an initial declaration or declare cessation of an activity must:

  • log on to their business eSpace on MyGuichet.lu;
  • select the procedure for the initial declaration entered when the studio/establishment was opened;
  • make a copy of the procedure and then select "Modification" (Modification) or "Cessation of activity" (Cessation d’activité).

Supporting documents

For each person declared, the declarant must attach a copy of either the attestation of attending a training course on hygiene or a copy of the diploma awarded.

The administration may ask for additional supporting documents.

The administration's response

The application is sent to the Health Directorate.

An inspector from the Health Inspection checks the information given by the declarant and either accepts or refuses the application.

If the application is accepted, the declarant receives:

  • a communication with the corresponding certificate, in the case of an initial application;
  • a communication including notification of acceptance.

Sanctions

A professional who does not declare their activity risks a prison sentence and/or a fine.

Appeal

A negative decision in response to a declaration is an administrative decision against which the usual means of appeal (non-contentious appeal, judicial appeal) may be pursued, provided the legal deadlines are complied with.

It is also possible to lodge an appeal with the Ombudsman.
