Registering with an occupational health service

Employers must register with an occupational health service or, failing this, set up their own internal occupational health service.

The following are the main occupational health services with which the employer may register:

  • the Multi-sector Occupational Health Service (Service de Santé au Travail Multisectoriel - STM);
  • the Occupational Health Association for the Tertiary and the Financial Sector (Association pour la Santé au travail des secteurs Tertiaire et Financier - ASTF);
  • the Industrial Occupational Health Service (Service de Santé au Travail de l'Industrie - STI). 

The main role of the occupational health service is to advise and assist the employer in his procedures related to health, ergonomics, hygiene and safety at work.

Who is concerned?

All employers must register with an occupational health service, or set up their own service in their business.

Large businesses must organise their own occupational health service if they employ:

  • between 3,000 and 5,000 employees, of which at least 100 carry out hazardous jobs;
  • or more than 5,000 employees.

Other businesses must:

  • either organise their own health service;
  • or register with an association organising an inter-business health service;
  • or register with the Multi-sector Occupational Health Service (STM).

Main health services:

  • Industrial Occupational Health Service (STI) for businesses which are members of:
    • the Fedil - Business Federation; or
    • the Federation of Luxembourg Construction and Civil Engineering Companies (Fédération des entrepreneurs luxembourgeois de construction et génie civil);
  • Occupational Health Association for the Tertiary and the Financial Sector (Association pour la Santé au travail des secteurs Tertiaire et Financier - ASTF) for companies in the tertiary and financial sectors that are a member of:
  • Multi-sector Occupational Health Service (STM) for businesses in all other sectors.

Costs

The contributions paid to the occupational health service are directly deducted by the Joint Social Security Centre (CCSS) from the payment of social contributions.

The contribution rate for employers using the STM is published each year in the Official Journal B (Mémorial B). For 2013, it is fixed at 0.11 % of the total wage bill.

The contribution rate for the STI is set each year during the annual general meeting. For 2013, it is fixed at 0.10 % of the total wage bill.

The contribution rate for the ASTF is also set during the annual general meeting. It amounts to EUR 45 per employee.

An employer who organises his own occupational health service must set up a specific department in his own business. This department must consist of at least one qualified occupational health practitioner working on a full-time basis.
