Filing an appeal where parents disagree with the recommendation for their child’s transition from the primary to classical or general secondary education

The recommendation made at the end of the fourth and final cycle of fundamental education (corresponding to primary education) and admission to classic or general secondary education are based on a guidance decision reached jointly by the parents and the class teacher at the end of the school year.

If the parents and the class teacher are in disagreement on the guidance decision for the child, they may appeal to the guidance committee, which will then deliberate on the matter.

Who is concerned?

The guidance procedure concerns all pupils at the end of the fourth cycle of fundamental school (at a public-sector school or a private-sector school following the official curriculum of the MENJE).

How to proceed

Individual interviews

During the first year of the 4th cycle, 3 individual interviews (one at the end of each term) are held between the class teacher (representing the teaching staff) and the parents, to discuss their points of view on the next stage in the pupil’s education.

A provisional recommendation is drawn up in the third term (i.e. at the third individual interview) by the class teacher, who at the same time provides the parents with information on the classical and general secondary education available, including specific offers (European education in the Grand Duchy’s public-sector schools, ‘ALLET’ classes, classes taught in French or in English, International Baccalaureate).

During the second year of the 4th cycle, 3 individual interviews (one at the end of each term) are held between the class teacher (representing the teaching staff) and the parents. At this second interview, the parents are notified of the pupil’s results in the common examinations and his/her academic results by means of intermediate school reports, and the results of tests carried out by the CePAS psychologist if the parents have opted for his intervention.

The third and final discussion during cycle 4.2 consists of a guidance interview. Normally the parents and the class teacher reach a joint guidance decision on the pupil’s transition.

Guidance decision

At the third and final discussion during cycle 4.2, the final recommendation is normally determined by the decision made jointly by the parents and the pupil’s class teacher. This decision is based on:

  • the pupil’s production during the 4th cycle, indicating what he/she has learned, is interested in, and aspires to;
  • the assessment of the pupil’s learning results, recorded in his/her intermediate school reports;
  • the pupil’s results in the common examinations (in German, French and mathematics);
  • the information gathered by the psychologist, if the parents have opted for his intervention.

The guidance decision is documented and signed by the parents and the class teacher. It entitles the pupil to enter one of the following classes:

  • year 7 in a classical secondary school 7C (enseignement secondaire classique);
  • Year 7 in a general secondary school - orientation scheme 7G (enseignement secondaire général de la voie d’orientation);
  • year 7 in a general secondary school - preparatory scheme 7P (enseignement secondaire général de la voie de préparation).

The parents then enrol their child at the secondary school of their choice, according to the type of education indicated in the decision.

Disagreement

In the event of disagreement on the recommendation for the pupil’s further education, the class teacher and the parents jointly send a form documenting their disagreement to the Chair of the guidance committee, together with the following documents:

  • the pupil’s production during the 4th cycle, indicating what he/she has learned, is interested in, and aspires to;
  • the assessment of the pupil’s learning results, recorded in his/her intermediate school reports (cycles 4.1 and 4.2);
  • the pupil’s results in the common examinations (in German, French and mathematics);
  • the information gathered by the psychologist, if the parents have opted for his intervention.

The guidance committee meets to assess the pupil’s situation and reach a decision. It is chaired by the regional director; its other members are:

  • one teacher from the 4th cycle of fundamental education;
  • one teacher active in classical secondary education;
  • one teacher active in general secondary education;
  • one psychologist from the Psychosocial and Scholastic Assistance Centre (Centre psycho-social et d'accompagnement scolaires - CePAS).

The parents are invited to attend, as is the class teacher, and the psychologist if the parents have opted for his intervention. The parents are given an opportunity to set out their arguments before the guidance committee.

The committee’s decision is transmitted to the parents and the class teacher by means of an electronic form. The parents transmit this decision to the head of the secondary school concerned.

The committee’s decision is final. No appeal may be made against it.
